The President of the United States takes an oath to uphold and defend the Constitution. Joe Biden took that oath but since he’s the illegitimate president he doesn’t feel like the oath applies to him. After admitting that a moratorium on evictions is unconstitutional, Biden went ahead and did it anyway. If there were a Republican in the White House, this would be a Constitutional crisis and a threat to democracy.
The CDC had issued a halt on evictions during the COVID-19 pandemic, meaning landlords could not throw tenets out for failing to pay their rent. The Supreme Court ruled that the eviction moratorium exceeded the CDC’s authority and that any further action must come from a law made by Congress. The eviction moratorium expired on July 31 and Congress hasn’t done shit about it.
Democrats in Congress apparently don’t understand their job as lawmakers and are bitching that the Biden administration hasn’t done anything to keep people from being evicted. Joe Biden announced yesterday that he was directing the CDC to reinstate the eviction moratorium even though he knows it’s unconstitutional.
“Whether that option will pass constitutional measure with this administration, I can’t tell you. I don’t know. There are a few scholars who say it will, and others who say it’s not likely to. But, at a minimum, by the time it gets litigated it will probably give some additional time while we’re getting that $45 billion out to people who are in fact behind in the rent and don’t have the money,” said Biden.
Wow. Think about that. Biden’s legal advisors have told him this is unconstitutional and there was that pesky Supreme Court ruling saying the same and yet he’s going to do it so he can get billions in spending out the door while it’s tied up in the courts.
It’s one thing to do something and then have the Supreme Court rule it’s unconstitutional like DACA, but Biden knows this is illegal and he’s still doing it.
The CDC did in fact issue a new eviction moratorium that lasts for 60 days:
The U.S. Centers for Disease and Control (CDC) is issuing a new order temporarily halting evictions in counties with heightened levels of community transmission in order to respond to recent, unexpected developments in the trajectory of the COVID-19 pandemic, including the rise of the Delta variant. It is intended to target specific areas of the country where cases are rapidly increasing, which likely would be exacerbated by mass evictions. Accordingly, subject to the limitations under “Applicability,” a landlord, owner of a residential property, or other person with a legal right to pursue eviction or possessory action, shall not evict any covered person from any residential property in any county or U.S. territory while the county or territory is experiencing substantial or high levels of community transmission of SARS-CoV-2.
And here’s the kicker, it comes with substantial penalties:
…a person violating this Order may be subject to a fine of no more than $100,000 or one year in jail, or both, if the violation does not result in a death, or a fine of no more than $250,000 or one year in jail, or both if the violation results in a death, or as otherwise provided by law.
What law? The CDC can’t make laws and neither can Joe Biden. This unconstitutional abomination is completely illegal.
Here’s nothing to think about: not all landlords are evil heartless corporations who can afford to take a hit on the rent. Many of them are mom and pop investors who haven’t been paid in over a year. The bank still gets their money, but many landlords are probably bankrupt because of this shit.
The democrats impeached President Trump twice; once for doing his job and a second time out of spite. At no point during his time in office did Trump ever violate the Constitution and yet the democrats tried to remove him from office under the guise of a constitutional crisis and for “eroding our institutions and damaging our democracy.”
Here is Joe Biden, a democrat. openly defying the Constitution and the the democrats are applauding him for violating the separation of powers. Breaking the law, violating the oath of office, and destroying democracy are not bad things when democrats do them.
